These Terms of Service ("Terms") govern your use of the website, booking system, memberships, and roadside services provided by GO Ape Roadside Assistance LLC ("Go Ape," "we," "our," or "us"). By using our services, you agree to these Terms.
1. Services
Go Ape provides mobile roadside assistance for light-duty passenger vehicles in San Diego County, including tire replacement, tire sales, battery replacement, battery sales, jump starts, lockouts, fuel delivery, and general roadside assistance. We do not service motorcycles or heavy-duty commercial vehicles.
2. Booking and dispatch
- Requests can be placed by phone, text, or online booking form.
- ETAs are estimates and depend on traffic, weather, and dispatch volume.
- You must provide an accurate location, a working phone number, and truthful vehicle information.
- You must ensure the vehicle is in a safe, legal, and accessible location for service.
3. Pricing and payment
- You will receive an up-front quote before dispatch. Additional fees may apply if scope changes at the scene.
- A non-member call-out fee of $55 typically applies. Members receive discounted rates.
- Payment is due at time of service via secure Stripe payment link.
- Chargebacks or disputes must first be raised with Go Ape in good faith.
4. Membership
- Membership plans renew automatically until cancelled.
- Benefits are subject to fair-use limits described on the Membership page.
- Membership does not guarantee immediate service; ETAs still depend on operating conditions.
- Cancel anytime; refunds are handled per the plan terms in effect at signup.
5. Customer responsibilities
- Be present (or have an authorized adult present) when the technician arrives.
- Provide accurate keys, wheel locks, and access needed to complete the service.
- Disclose known safety issues with the vehicle.
- Follow the technician's safety instructions on-scene.
6. Limitations and liability
Go Ape will perform services in a workmanlike manner using reasonable care. To the maximum extent permitted by law, Go Ape is not liable for pre-existing damage, mechanical conditions, aftermarket components, or consequential damages arising out of vehicle conditions outside our control. Our maximum liability for any claim is limited to the amount paid for the specific service giving rise to the claim.
7. Refusal of service
We may refuse or discontinue service if a scene is unsafe, if a vehicle is outside our service scope, if payment cannot be verified, or if a customer behaves abusively toward our team.
8. Intellectual property
The Go Ape name, logo, website content, and materials are the property of GO Ape Roadside Assistance LLCand may not be copied or used without permission.
9. Governing law and venue
These Terms are governed by the laws of the State of California, without regard to conflict of laws principles. Any dispute arising out of or relating to these Terms or our services will be resolved exclusively in the state or federal courts located in San Diego County, California, and you consent to the personal jurisdiction of those courts.
10. Changes
We may update these Terms at any time. Continued use of our services after changes are posted constitutes acceptance.
